1. Scope

MoveableIQ (also referenced as demo.moveableiq.com) is the school district's attendance system. It is used by authorized district staff and authorized contributors for district operations, principally the weekly attendance-intervention workflow.

These terms cover two different audiences, and both are binding. Sections 2 to 5 and 7 to 12 govern staff use of the system, and apply to the people who sign in to it. Section 6 governs the text message program, and applies to the parents and guardians who receive those messages. A family receiving a text is not a user of this system and is not asked to agree to the staff sections; section 6 stands on its own and describes what the district may send, what it may not, and how to stop it.

2. Authorized users

Access to this system is restricted. By signing in, you represent that:

• You are a current district employee, contractor, or authorized agent;
• You have completed any FERPA or student-data training required by the district;
• You will use the system only for district work that is within your assigned role and within the schools that have been assigned to your account by an administrator.

3. Acceptable use

You agree to use the system in good faith, which includes:

• Logging family contacts truthfully and avoiding student-identifying details in free-text notes;
• Not attempting to access schools or students outside your assigned scope;
• Not sharing your account credentials with anyone, including coworkers;
• Not copying, exporting, distributing, or screenshotting student-level information from the system except as required by your role and authorized by district policy;
• Reporting suspected security incidents, account compromises, or data exposure to your administrator promptly.

4. Account responsibility

You are responsible for activity performed under your account. Lock or sign out of the system on shared devices. If you believe your account has been compromised, contact your administrator immediately so the account can be unlocked, reset, or deactivated.

5. Data ownership

Student attendance data displayed by MoveableIQ is owned by the district and its data partners (e.g., its student information system). The contact-log records produced by use of this system are likewise owned by the district. Personnel responsible for operating and maintaining the system access district data only as necessary to do so on the district’s behalf.

6. Text messages to families

MoveableIQ can send text messages to a parent or guardian about their own student’s attendance: absences, attendance concerns, and what the family can do next. Messages are sent by a staff member deciding to send one, to one family, about one student. There are no marketing texts, nothing sends on a schedule, and no message goes to anyone who is not the parent or guardian of an enrolled student.

A family must agree before any text is sent to them, and agreeing is optional. Consent is requested through a link emailed to the address the district holds for that family, and it applies to the specific mobile number on file. If that number later changes, consent does not carry over to the new number and the family is asked again. A family who does not agree, or who never answers, is simply not texted; enrollment, attendance records, and access to school services do not depend on the answer, and the district continues to reach them by phone or email.

A family can reply STOP to any message to stop receiving texts, or HELP for help. Opt-outs are honored automatically by the messaging service that carries them, and this application also marks a number that has opted out so the text channel is no longer offered to staff for that family. Message frequency varies. Message and data rates may apply through the family’s own mobile carrier; MoveableIQ makes no charge for the service.

A mobile number and a family’s answer are not shared for marketing. Neither is shared with third parties or affiliates for marketing or promotional purposes, and neither is sold or rented. A number is used only to send the district’s own attendance messages to the family it belongs to, and is passed only to the carrier that delivers them.

An opt-out is carried out by the messaging service itself, not by MoveableIQ, so it cannot be reversed here. A family who later wants texts again has to text START from the same number. Neither the district nor MoveableIQ can turn them back on on the family’s behalf.

7. Software license

The MoveableIQ application code is proprietary to the district, provided for internal use under the LICENSE included with the source repository. It is not licensed for redistribution outside the district.

8. Availability and changes

We aim to keep the system available during normal school hours but do not guarantee uninterrupted operation. Maintenance, deployments, or third-party outages (e.g., the mail or messaging provider, the database host) may interrupt access. Features may be added, changed, or removed without notice as the program evolves; substantive changes will be communicated to administrators when feasible.

9. Disclaimer

The system is provided “as is” without warranties of any kind, express or implied. MoveableIQ surfaces calculations and suggested communications to support staff judgment; it does not replace the judgment of the staff member or administrator using it. Decisions about a specific student remain the responsibility of the school and the district under applicable law and policy.

10. Termination

Access is granted at the discretion of the district and may be revoked at any time, including upon end of employment, role change, violation of these terms, or at the request of the district or the school administration.

11. Governing law

These terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws principles, and apply to use of the system by district staff and authorized contributors.
